Terms of Service

These Terms of Service ("Terms") govern your use of TailyArt, operated by Leadiser Limited ("we", "us", "our"). By accessing or using TailyArt at tailyart.com, you agree to be bound by these Terms.

If you do not agree, please do not use our service.

1. The Service

TailyArt allows users to upload photos and generate AI-powered portrait artwork in various artistic styles. Generated portraits can be downloaded as digital files or ordered as physical prints fulfilled by our print-on-demand partner, Gelato.

You do not need an account to generate a portrait or complete a purchase. Account creation is optional and provides access to your order history and saved portraits.

2. Eligibility

You must be at least 13 years old to use TailyArt. By using the service, you confirm that you meet this age requirement. Users under 18 should have parental or guardian consent.

3. Your Content

• You retain ownership of any photos you upload to TailyArt.
• By uploading a photo, you grant us a limited licence to process and analyse it solely for the purpose of generating your portrait.
• You must have the right to use any photo you upload. Do not upload photos of other people without their consent.
• Do not upload content that is illegal, obscene, hateful, or that infringes the rights of others.
• We reserve the right to reject or remove content that violates these Terms.

4. Generated Portraits

AI-generated portraits produced by TailyArt are intended for personal use. Upon purchase of a digital download or print, you receive a non-exclusive licence to use the portrait for personal, non-commercial purposes.

Commercial use of generated portraits (e.g. resale, advertising) is not permitted without prior written consent from Leadiser Limited.

AI generation results may vary. Because generation involves creative AI models, we cannot guarantee exact likeness or a specific output.

5. Purchases & Payments

All prices are displayed inclusive of applicable taxes where required. Payments are processed securely via Stripe. We do not store your payment card details.

Digital downloads are delivered immediately after payment confirmation. Because digital content is made available instantly, you acknowledge that you waive your right to cancel once the download has been made available.

Physical prints are produced and shipped by Gelato. Delivery times vary by destination. We are not responsible for delays caused by couriers or customs.

6. Refunds

Digital downloads: Refunds are not available once a digital file has been delivered, except where required by applicable law or where the file is materially defective.

Physical prints: If your print arrives damaged or with a manufacturing defect, contact us at info@tailyart.com within 14 days of receipt with a photo of the issue. We will arrange a replacement or refund at our discretion.

We do not accept returns for prints that were produced correctly according to your order.

7. Prohibited Use

You agree not to:

• Use TailyArt for any unlawful purpose.
• Upload content that violates the rights of others or applicable laws.
• Attempt to circumvent rate limits, abuse the generation pipeline, or scrape the service.
• Reverse-engineer, decompile, or attempt to extract the underlying AI models or source code.
• Resell or redistribute generated outputs commercially without our written consent.

8. Intellectual Property

The TailyArt name, logo, website design, and underlying technology are the property of Leadiser Limited and are protected by intellectual property law. You may not reproduce or use them without our prior written permission.

9. Disclaimer of Warranties

TailyArt is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or produce results that meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Leadiser Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of TailyArt. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of TailyArt at any time. We will provide reasonable notice where practicable but are not obligated to do so.

12. Changes to These Terms

We may update these Terms from time to time. The updated date at the top of this page will reflect any changes. Continued use of TailyArt after changes have been posted constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
